So far as permissible by law, we do not accept any liability to any person relating to the use of any such information.

8.2. Our site is intended only for use by UK residents and only in relation to their activities within the UK. It may be dangerous to apply any of the information on our site to activities outside the UK.

8.3. Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

You warrant to us that you will not use our site, the Material or any part thereof for any purpose that is in contravention of any applicable law or regulation or in a manner that will infringe the copyright, trademarks, service marks or other intellectual property rights of third parties or violate the privacy, publicity or other personal rights of others or in any defamatory, obscene, threatening, abusive or hateful manner. You shall indemnify and hold harmless National Star Foundation, its employees and agents, against all claims, liability, losses, damages and expenses including, without limitation, legal fees and costs arising out of or incurred as a result of any claims made, or litigation brought, against National Star Foundation, its employees and agents, as a result of the use by you of our site, the Material or any part thereof for whatever purpose, to the fullest extent permitted by law. 

  1. Limitation of our Liability

10.1. Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10.2. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our site or any content on it, whether express or implied.

10.3. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with

  • use of, or inability to use, our site
  • use of, or reliance on any content displayed on our site.

10.4. If you are a business user, please note that in particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

10.5. If you are a consumer user, please note that we only provide our site for domestic and private use. 11.1. We do not guarantee that our site will be secure or free from bugs or viruses.

11.2. You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

11.3. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

12.1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

12.2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

  1. Online Transactions

14.1. We reserve the right to vary event registration fees and the prices of any goods or services listed without notice. All event registrations and orders for goods or services are subject to availability and we reserve the right to refuse to accept any registration and to refuse to supply any goods or services to any individual.

14.2. By placing an order with us, you are accepting our terms and conditions in the supply of goods or services

14.3. Your credit or debit card will only be charged at the time of dispatch.

14.4. Whilst we endeavour to keep all items in stock and available for immediate dispatch, this may not always be possible. In the event that an item is temporarily out of stock we will ship the balance of your order and forward on the remaining items at no extra cost when available. If an item has been discontinued or we are unable to secure further stock of any item, we will cancel that order. Please note, as with all Online Shopping, your completion of the checkout process does not explicitly guarantee we are able to supply the goods ordered.

14.5. With our Standard Delivery service, we aim to dispatch goods held in stock within 72 hours of receiving your order, and often sooner. Delivery will be made as soon as possible thereafter. Purchases may be delivered to any UK mainland address, providing the card holder provides their registered home address. For security reasons, telephone orders can only be delivered to the card holder's registered address unless a previous purchase has been made. Please note that we are unable to accept liability for any delay to your delivery that is beyond our control.

14.6. If you are not entirely satisfied with your order, we will be happy to offer a full refund or exchange providing the goods are returned unused and in their original packaging within 14 days. Regrettably the Returns postage is a direct cost to you and will not be refunded unless an item is deemed faulty or damaged.

14.7. Once you have confirmed your order and payment with us, you have entered into a contract to purchase these goods from us. You have a right to cancel your order within 14 days of receipt of goods and receive a full refund.

14.8. StarShop has taken great care to ensure the reproduction of colour is as accurate as the photographic and production process allows. Some items are handmade, actual size and colour may vary slightly but this is indicated in the product copy. We make every attempt to ensure our prices are accurate. In the event of a pricing or description error we reserve the right to withdraw an item from sale, under the terms of the Sale of Goods Act. We reserve the right to amend, modify or withdraw temporarily or permanently any price or product description without notice. VAT is included at the standard rate on all applicable items. 

14.9. We reserve the right to reject an order as a result of any of the following:

  • The product you ordered is unavailable from stock.
  • We are unable to obtain authorisation for your payment.
  • We have identified a pricing or product description error.

We reserve the right to amend, modify or withdraw temporarily or permanently any price or product description or terms and conditions with or without notice.  You shall not hold us liable for any such modification, amendments or withdrawals.

15.0 Confidentiality

15.1. Your name and address details will not be exchanged or handed to any third party, unless required to do so by law.

15.2. We confirm that any personal information which you provide to us, or which is available via public registers and any user information from which we can identify you, is held in accordance with the registration we have with the Data and Information Commissioner's Office. We use your information only for the following:

      • Processing your orders
      • Carry out surveys to help improve this website and any of its services to you
      • To send you occasional advertisements and website content
      • To enable us to administer this website
      • If you have consented, to notify you of products or special offers that may be of interest to you, or to provide you with a periodic newsletter. 
      1. Encryption

16.1 Although our site uses encryption security software in areas where online payment details are accepted, the security of information and payments transmitted via the internet cannot be guaranteed. Any loss incurred or sustained when you transmit information by means of e-mail or other internet links shall be borne solely and exclusively by you and in no event shall any such loss in whole or part be borne by us or our agents.

      1. Force Majeure

17.1. We shall not be held to be in breach of our obligations hereunder nor liable to you for any loss or damage which may be suffered by another party due to any cause beyond our reasonable control including without limitation any act of God, fire, storm, flood, lightening, disease, strike, trade dispute, act of terrorism, any act or omission of government or regulatory bodies or communications operators.

      1. General

18.1. If any provisions of these terms and conditions are held to be invalid or unenforceable, the validity or enforceability of the remaining provisions shall not be affected.

18.2. These terms and conditions constitute the entire agreement between us and you and supersede all other (prior or contemporaneous) communications and proposals, whether electronic or written, between us and you.

18.3. Any failure by us to exercise or enforce any of our rights under these terms and conditions shall not be deemed to be a waiver of any such rights or operate so as to bar the subsequent exercise or enforcement or any such rights. 

      1. Applicable Law

19.1. If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

19.2. If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
